  • The website https://neumann.company/ ("site"), edited by the company Neumann (hereby "Neumann" or "we") is Neumann's institutional website.

  • Accessing, consulting, browsing, and/or using the site constitutes full and unconditional acceptance of these general terms of use ("GTU"), which aim to define the terms of use of the site by any natural person.

  • Before using the site, we invite you to read these GTU carefully. If the user refuses the provisions of these GTU, they are kindly requested not to use the site.

Access to the site is available twenty-four (24) hours a day, seven (7) days a week, subject to the occurrence of a disruptive event.

In the event of a breach of these GTUs or applicable regulations, including any unauthorised use of the site observed by Neumann, the latter reserves the right to terminate the present contractual relationship, automatically, as well as to block any future access by the user to all or part of the site.

3. Intellectual Property

The site and all the elements composing it or made available to users are the property of Neumann or are subject to a licence granted to it by any holder of intellectual property rights. All these elements are subject to the provisions of French and international legislation on intellectual property, specifically the Intellectual Property Code, and therefore, they are protected against any unauthorised use by law or the general conditions of use, resulting in, in the event of violation, legal proceedings.

Neumann grants the user a personal, non-exclusive, and free right to consult and use the site and its services for their own use and within the strict framework of the operations authorised under these GTU.

Subject to the rights of use granted to the user by Neumann, the use of the site does not entail any licence or transfer of rights relating to the elements of the site to the user. In particular, any copying, reproduction, representation, adaptation, modification, full or partial dissemination of the site, is unlawful without prior, express, and written authorization from Neumann or the holder of the intellectual property rights.

This is without prejudice to Neumann's other rights, in particular the right to obtain compensation for damages suffered.

The site is provided to the user free of charge. Although Neumann strives to provide a reliable site, Neumann does not guarantee that it is free from vulnerabilities or defects. Thus, Neumann cannot be held responsible for direct or indirect damages that may result from any breach of the obligations stipulated in these general terms of use resulting from a fortuitous event or force majeure, as defined by Article 1218 of the Civil Code.

In the event that Neumann is held liable for damages not provided for in this article, its liability shall be limited to certain, actual, and direct damages.

 

5. Modification

These GTU are precisely dated and may be modified and updated by Neumann at any time, particularly in the event of changes to the site or applicable regulations. The user is encouraged to consult the general terms of use each time they visit the site.

6. Termination of the site

Neumann reserves the right to temporarily or permanently suspend access to all or part of the site, particularly in the event of cessation of the activity related to the provision of the site or in the event of insolvency proceedings.

Subject to applicable law, the user agrees that these GTU, which bind them to Neumann, may be assigned, transferred, or contributed to in any way. In the event of a transfer of the company to a third party, these GTU binding the user to Neumann will be automatically transferred to the assignee.
